COMPETITION TERMS AND CONDITIONS

1. The Promoter

The promoter is Hays Specialist Recruitment Limited whose registered address is 4th Floor, 20 Triton Street, London, NW1 3BF (the “Promoter/Hays Technology”).

2. The Competition

Hays Technology and Manchester City Football Club (“MCFC”) Retweet and Follow to Win April/May 2022 Competition, a chance to win one of seven Manchester City shirts signed by several members of the men's and women’s first team squads (“Competition”). The prize (“Prize”) for the Competition is:

       - 5 winners will each receive 1 jersey signed by one or several first team squad members

2.2.  By entering this competition, you agree to be bound by these Terms and Conditions together with any other specific instructions and additional terms  introduced by Hays or its affiliates. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Competition.

2.3. The Competition is free to enter and no purchase is necessary

3. How to Enter

3.1 The Competition will run from 09:31 BST on Friday 29 April 2022 (“Opening Date”) to 23:59 BST on Sunday 8 May 2022 (“Closing Date”) inclusive (“Promotion Period”). All Competition entries received after the Closing Date will not be accepted. Entrants must follow the @HaysTechnology Twitter account and ‘retweet’ the initial competition launch tweet within the Promotion Period (“Entry”). Any retweets of the competition launch tweet made outside the Promotion Period are incorrect entries and ineligible for the Competition. All Competition winners’ Entries, Twitter usernames, names, photographs and other reasonable details may be used by the Promoter on its digital channels and in public relations outreach to UK media outlets. IF YOU DO NOT AGREE, DO NOT SUBMIT AN ENTRY.

3.2 The Promoter will not accept:

(a) any Competition entry which does not comply with clause 3.1 of these terms and conditions; or

(b) responsibility for Competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

4. Eligibility

4.1. The Competition is open to all Twitter account holders aged 18 years or over, except for:

(a) employees of the Promoter or its holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Competition or its administration; or

(c) families of (a) and (b) above.

4.2. In entering the Competition, you confirm that you are eligible to do so and eligible to claim the Prize if you win. The Promoter may require you to provide proof that you are eligible to enter the Competition, including but not limited to, proof that you are aged 18 or over. The Promoter will not accept Competition entries that are automatically generated by computer, completed by someone else, third parties or in bulk or otherwise not in the spirit of one Entry per person. There is a limit of one entry per person.

4.3. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Prize and/or Competition.

5. Winner

5.1. Five winners will be chosen by random draw by an independent person on Monday 9th May 2022 (“Draw Date”). Any decision made by the Promoter (or such third party the Promoter appoints) regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.

5.2. The Promoter will contact the winners directly within 24 hours of the Closing Date, from the Twitter account for Hays Technology: @HaysTechnology.

6. Claiming the prize

6.1. To claim the Prize, a winner must respond to the tweet, which states you are a winner, with your full name and postal address details within 24 hours of being contacted. The Prize is non-exchangeable, non-transferable and no cash alternative is offered.

6.2. Hays will deliver the Prize as soon as reasonably practicable. The Promoter will make reasonable efforts to contact the winners. If a winner cannot be contacted or is not available or does not respond to the Promoter within 24 hours of being contacted by the Promoter, then the winner’s prize will be forfeited and the Promoter will be entitled to select a replacement winner from the eligible entries that were received before the Closing Date.

6.3. The Prize may not be claimed by a third party on your behalf.

6.4. The Promoter does not accept any responsibility for the winner failing to collect the Prize.

7. Limitation of Liability

7.1. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

7.2. The Competition will be run by the Promoter and is not in any way administered by MCFC. By entering this competition, you acknowledge that MCFC shall not, subject to any applicable laws, have any liability to any Competition entrants or the winner in connection with this Competition or the Prize. MCFC cannot be held responsible for any claims relating to the Prize.

8. Ownership of Competition Entries and Intellectual Property Rights

8.1. All Competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter upon receipt and will not be returned. By submitting your Entry and any accompanying material, you agree to:

(a) assign to the Promoter all your intellectual property rights with full title guarantee; and

(b) waive all moral rights,

in and to your Entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

8.2. You agree that the Promoter may, but is not required to, make your entry available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the Competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the Entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the Entry and any accompanying materials for such purposes.

9. Data Protection and Publicity

10. General

10.1. The Promoter reserves the right to hold void, suspend, cancel, or amend the Prize and/or Competition where it becomes necessary to do so.

10.2. These Terms and Conditions constitute the entire agreement between the parties and supersede and extinguish all previous drafts, agreements, arrangements, and understandings between them, whether written or oral, relating to its subject matter.

10.3. The validity, construction and performance of these Terms and Conditions shall be governed by English law and shall be subject to the exclusive jurisdiction of the English courts.
